This End User License Agreement (EULA) is between Lookasoft (“Licensor”) and the end-user (“You” or “Your”) and governs the use of the Lookasoft software (“Licensed Software”). By clicking “Accept” or using the Licensed Software, You agree to be bound by the terms of this EULA. If You do not agree to the terms of this EULA, do not use the Licensed Software.
The Licensed Software is an iOS system repair software. It includes all software, media, printed materials, and electronic documentation.
Licensor grants You a non-exclusive, non-transferable license to use the Licensed Software on a single device in accordance with the terms of this EULA. The Licensed Software is licensed, not sold, to You.
You may not modify, decompile, disassemble, or reverse engineer the Licensed Software or create any derivative works based on the Licensed Software. You may not rent, lease, lend, sell, redistribute, or sublicense the Licensed Software. You may not use the Licensed Software for any commercial purposes.
You may choose to participate in the Lookasoft Software Improvement Program. If You decide to participate, Lookasoft may collect information about Your use of the Licensed Software to improve its products and services. Lookasoft may use this information in accordance with its Privacy Policy.
You may install the Licensed Software on a single device for Your personal use. You may not use the Licensed Software on a device that You do not own or control.
The Licensed Software requires activation before it can be used. Activation requires an internet connection and may require submitting certain information, including Your name and email address. You may not activate the Licensed Software on more devices than the number of licenses purchased.
If You obtained the Licensed Software as an evaluation copy, Your license is limited to the evaluation period. Upon the expiration of the evaluation period, You must either purchase a license or remove the Licensed Software from Your device.
This EULA is effective from the date You first use the Licensed Software and continues until terminated. You may terminate this EULA at any time by uninstalling the Licensed Software and destroying all copies of the Licensed Software in Your possession. The license granted under this EULA is personal to You and may not be transferred to another person or entity.
Lookasoft may, in its sole discretion, provide updates to the Licensed Software. These updates may include bug fixes, new features, and other enhancements. By using the Licensed Software, You agree to receive such updates.
All notices required or permitted under this EULA will be in writing and will be deemed given when delivered by email or confirmed fax to the email or fax address of the party to be noticed, as outlined in the registration information provided by You or such other address as a party may specify in writing.
Licensed Software is protected by copyright and other intellectual property laws. Lookasoft owns all rights, title, and interest in and to the Licensed Software, including all intellectual property rights. This EULA does not transfer ownership rights in the Licensed Software to You.
Lookasoft may provide technical support for the Licensed Software. The availability of support and the terms and conditions of such support may be changed by Lookasoft at any time without notice.
LOOKASOFT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. LOOKASOFT DOES NOT WARRANT THAT THE LICENSED SOFTWARE WILL MEET YOUR REQUIREMENTS OR THAT THE USE OF THE LICENSED SOFTWARE WILL BE UNINTERRUPTED OR ERROR-FREE. THE LICENSED SOFTWARE IS PROVIDED ON AN “AS IS” BASIS.
In no event will Lookasoft be liable for any damages, including but not limited to direct, indirect, incidental, special, consequential, or punitive damages, arising out of the use or inability to use the Licensed Software, even if Lookasoft has been advised of the possibility of such damages.
Lookasoft reserves the right to modify this EULA at any time and without prior notice. Your continued use of the Licensed Software following any modification to this EULA constitutes Your acceptance of the amendment.
You are responsible for periodically reviewing this EULA to be aware of any changes. If You do not agree to the modified terms, You must immediately stop using the Licensed Software.
You agree to indemnify, defend, and hold harmless Lookasoft from and against any claims, damages, costs, and expenses, including attorney’s fees, arising from Your use of the Licensed Software.
The Licensed Software may allow You to submit, upload, publish, or otherwise make available content, including but not limited to text, photographs, and videos (“End-User Generated Content”). You retain all rights to Your End-User Generated Content and are solely responsible for Your End-User Generated Content.
You grant Lookasoft a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, copy, modify, create derivative works based on, distribute, publicly display, publicly perform, and otherwise exploit Your End-User Generated Content in connection with the Licensed Software.
Export Control The Licensed Software may be subject to export control laws and regulations. You agree to comply with all applicable export control laws and regulations.
This EULA will be governed by and construed in accordance with the laws of the jurisdiction in which You reside. Any dispute arising out of or relating to this EULA will be resolved through binding arbitration under the commercial arbitration rules of the American Arbitration Association. The arbitration will be conducted in the jurisdiction in which You reside.
This EULA constitutes the entire agreement between You and Lookasoft. It supersedes all prior negotiations, understandings, and agreements between the parties.
If any provision of this EULA is found invalid or unenforceable, the remaining provisions will remain in full force and effect. Lookasoft may assign this EULA, in whole or in part, at any time without notice to You.
You may not assign this EULA without the prior written consent of Lookasoft. This EULA will be binding upon and inure to the benefit of the parties hereto and their respective successors and assigns.
By clicking “Accept” or using the Licensed Software, You agree to be bound by the terms of this EULA.
You agree to use the Licensed Software in compliance with all applicable laws and regulations, including but not limited to ordinances and regulations relating to data privacy and security. You are responsible for obtaining all necessary consents and approvals for Your use of the Licensed Software.
You agree to maintain the confidentiality of all confidential information of Lookasoft and/or its licensors, which You have access to as a result of Your use of the Licensed Software. You agree not to disclose such confidential information to any third party.
The Licensed Software may contain third-party software which requires notices and/or additional terms and conditions.
Such required third-party software notices and/or additional terms and conditions are made a part of and incorporated by reference into this EULA. By accepting this EULA, You are also accepting the additional terms and conditions, if any, set forth therein.
This EULA is effective until terminated. You may terminate this EULA at any time by destroying all copies of the Licensed Software in Your possession or control. Lookasoft may terminate this EULA at any time if You breach any term of this EULA. Upon termination, You must destroy all copies of the Licensed Software in Your possession or control.
The Licensed Software is provided for informational purposes only. Lookasoft does not warrant or guarantee the accuracy or completeness of any information in the Licensed Software. You assume all risks associated with the use of the Licensed Software.
